Cerebral Palsy and Birth Injury

Cerebral palsy is a medical condition of the brain which affects movement control. While some forms of cerebral palsy are caused by abnormal brain formation, other forms are caused by injury to the brain due to medical negligence before, at or shortly after a child’s birth.

Medical negligence which causes cerebral palsy usually arises from a doctor or nurse’s failure to identify and timely deliver a child suffering from fetal distress. When this occurs, the unborn child can suffer a lack of oxygen to the brain, causing cerebral palsy.

Other acts of medical negligence which can cause cerebral palsy are the failure to timely perform a c-section, failure to order appropriate tests to assess the unborn child’s condition and prolonged vacuum extraction during delivery. These acts can cause the child to suffer from a lack of oxygen, or suffer a traumatic brain injury such as a brain hemorrhage, both of which can cause cerebral palsy.
